Crypto startups have 54 days to influence SEC's proposed 75 million dollar fundraising cap
The US Securities and Exchange Commission (SEC) has received 31 public comments regarding its proposal for two crypto fundraising exemptions as of Aug. 27, with comments due by Oct. 20. This leaves 54 days for additional feedback. The proposed exemptions would allow eligible crypto ventures to raise up to 5 million dollars in any four-year period and up to 75 million dollars in each 12-month period. Commenters are addressing the mechanics of the exemptions, focusing on disclosure, investor protections, and the 75 million dollar ceiling. Ohanae Securities requested clarification on the 75 million dollar exemption and proposed additional disclosures. ARKONIX questioned whether independent offerings should share the 75 million dollar ceiling if they use the same infrastructure. Other commenters, like Beeezo, sought distinctions between genuine commercial activity and services provided for token issuance. Tilden Moschetti opposed the startup exemption and suggested changes to eligibility and investment limits. The Digital Chamber noted that one submission was a meeting memorandum rather than a public comment and highlighted its Token Alliance's previous responses to SEC inquiries. The Oct. 20 deadline is critical for shaping the final rulemaking.
